Knowing What to Expect in the Juvenile Justice System
When a child has been accused of a crime, most parents are terrified about what will happen to their child. At Berglund Law, PLLC, in Boise, Idaho, we can help them know what to expect.
We tell parents that, in Idaho, most juvenile crimes are handled in a separate juvenile court. Rather than punishment and segregation, the focuses of adult courts, juvenile justice courts focus on rehabilitation. This means that juvenile offenders who enter the juvenile justice system do so with the goal of becoming more productive members of society. They usually experience probation or community service, but in some cases may spend time in juvenile detention.
This does not necessarily mean that juvenile records just disappear. Increasingly, prosecutors use juvenile records to increase sentences on adult offenses or to increase bond on subsequent crimes by including these earlier offenses as part of the person's criminal history when presenting it to a judge. Juvenile records which are not sealed or expunged may also be viewed by the public in an online database.
In order to prevent this from happening, some juvenile crimes can be expunged — or sealed. For this reason, it is important to have an attorney who understands the different options available to protect a juvenile's future.
