- Petty theft: Under Idaho law, petty theft refers to a theft crime where the item taken was valued under $1000. This charge often relates to theft from an employer, shoplifting, or retail theft.
- Grand theft: Grand theft is charged if the item or items allegedly stolen are said to be worth over $1000. This crime can be charged in different ways: It can refer to one large stolen item, multiple items stolen at one time where the total value of all property stolen is greater than $1,000, or it can consist of a serious of three or more smaller thefts over a short period of time as part of a common scheme or plan.
- Robbery: Robbery involves taking something by force or extortion from someone's person.
Proving Theft Charges
Theft is the taking of a property of another. In a theft case, the state has the burden of proof to prove that the taking was done with the intent to permanently deprive the owner of the property or its value.
In preparing a theft defense, it is critical to remember that the state must prove this intent. It is the state's responsibility, for example, to show that you did not have the money to pay for a shoplifted item or that no efforts were taken to pay for it before you left the store.
